House Judiciary Committee Hearing on Plyler

On Wednesday, the House Judiciary Committee’s Subcommittee on the Constitution and Limited Government held a hearing entitled “Immigration Policy by Court Order: The Adverse Effects of Plyler v. Doe.” ܲAVƵjoined 109 organizations in a statement for the record that emphasized the need to ensure all children have access to a high-quality public education and outlined how Plyler benefits immigrant children and the broader community. Most of the hearing centered around legal arguments for why the Plyler decision should be overturned. The majority members also focused on the cost of educating undocumented students “to the detriment of American students,” while the minority members worked to combat this narrative and articulate the importance of keeping all students in school. Additionally, much of the conversation conflated English language learners and undocumented students.

This hearing is part of a coordinated effort by conservative lawmakers and thought leaders to overturn the landmark Supreme Court decision. Since last year, six states have introduced legislation or rules that would challenge or undermine the decision.
